In light of potential staffing shortages, many members have inquired about overtime. OT is covered under Article 8 of the MOU. Basically, if you are rank and file, work week group 2, the State must compensate you for OT after you have put in 40 hours in a week. That compensation can be, at management's discretion, either CTO or cash - they are supposed to take an employee's wishes into account. They must count vacation, sick leave, etc. as part of the 40 hours. Management may require work week group E (seniors) to work more than 40 hours in a week but are supposed to average out to 40. if possible.
In addition, you must work OT if
a job requires it and you are told to, unless you have a VERY good reason why
you cannot (e.g. safety concern). However, you cannot be forced to shorten your
scheduled work hours to avoid OT. For example, if you are told you must work
4 hours extra on Monday, you cannot be forced to take time off later in the
week to avoid exceeding the 40 hrs/week. If you are scheduled to work 8 hrs/day
Tues-Fri, you should get 6 hours of CTO or pay. Nevertheless, with budget conditions
as they are, members should try to work out things with their supervisor.
